Are Truck Drivers Allowed to Use Cell Phones in Texas?

The federal agency prohibits truck drivers from using handheld devices while operating their vehicles. This law includes holding a phone to make or send texts, calls, emails, or any other function that requires a driver to manually manipulate the device. The FMCSA defines the ‘use of a mobile phone,’ as any of the following:
- Using at least on hand to make a call while holding a phone,
- Pressing more than a single button to dial a mobile phone, or
- Reaching for a cell phone in such a way that requires the driver to shift from a seated position, restrained by a seat belt.
State law also prohibits all drivers, including truckers, from writing, reading, or sending electronic messages while operating a vehicle.
Truck Drivers and Hands-Free Devices
Although truck drivers are not allowed to use handheld devices while operating their vehicle, they can use hands-free technology. Hands-free devices such as speakerphones or Bluetooth headsets can still allow truck drivers to stay connected to other drivers and the company they work for without putting their safety at risk. Still, even when truck drivers use a hands-free device, they must remain focused on the road at all times and always exercise caution.
Exceptions for Emergencies
There are certain emergencies that may require a truck driver to use a cell phone even while operating their vehicle. For example, if there is an immediate threat to their own personal safety, or the safety of other people on the road, a truck driver can use their cell phone to call for emergency help. Such a threat could include drunk drivers, an accident that just happened in front of the trucker, or an obstacle on the road that is difficult to navigate around. Even in these situations, truck drivers should always exercise discretion and use their cell phones only when it is absolutely necessary and safe to do so.
